In September 2015, the Board adopted the California School Boards Association (CSBA) Agenda Online program in an effort to save time and expense in the preparation of the agendas and the way Board of Education meetings would be conducted.

With CSBA’s change to GAMUT, there was interest in exploring other programs that may better fit the District’s format and ease use for the Governing Board. BoardDocs’ online agenda program by Diligent provides a much easier work flow and easier to use methods of building agendas and facilitating Board of Education meetings.

District administration recommends the Board approve the BoardDocs program through Diligent from June 1, 2022 through June 30, 2023.

Financial Impact:

$12,000 annual fee to be paid from the District General Fund

Throughout the year, changes in the law, Education Code and/or district procedures necessitate new and revised policies. These changes have caused the District to review existing policies and look to establish new and timely ones. Contained in the agenda for first and second reading is the following Board Policies (BP), Administrative Regulations (AR), Exhibits (E), and Board Bylaw (BB):

BP                   Nondiscrimination in Employment – The Board Policy is being revised due to new

4030                law regarding the maintenance of records.

E                      Employee Notifications – The Exhibit is being revised to update it according to law

BP/AR            Admission – The Board Policy and Administrative Regulation are being revised

SAC Early College Academy students, to complete college-level credit and courses while also receiving credit for high school graduation.

All organizations listed below will provide services through licensed, pre-licensed, or intern therapists. Pre-licensed and intern therapists will be supervised by a Licensed Marriage and Family Therapist, a Licensed Clinical Social Worker, or a Licensed Psychologist.

Board approval is requested on the following MOU’s for counseling services during the 2022–2023 school year. 

Asian Pacific Counseling & Treatment Centers, Bienvenidos, an affiliate of Hillsides Mental Health Services, ENKI Health & Research Systems, Inc., Foothill Family Services, and Pacific Clinics will provide on-site counseling services to eligible West Covina Unified School District students and their families who are referred by designated school staff.

IX.C.3. Declare Salaries for Unrepresented Employees Indefinite for 2022 – 2023 (Consent Item)

Rationale:

Salaries of represented employees become indefinite upon expiration of the collective bargaining contract or the salary provisions of the contract.  Salaries of management, confidential and other unrepresented employees are set by the Board of Education.  California Constitution (Article 11, Section 10) prohibits employees not covered by a contract from receiving additional compensation for services already rendered.  As a result, retroactive pay is precluded for unrepresented, management and confidential employees except in instances where salaries are declared indefinite by the governing board in advance of the new school year.

As a result of financial uncertainties, negotiations, legislation, and other factors, the District  administration recommends that the Board of Education declare all management, confidential, and other unrepresented employee salaries indefinite for 2022 – 2023.

IX.C.4. Declaration of Need for Fully Qualified Educators (Action Item)

Rationale:

Under State law, the California Commission on Teacher Credentialing is authorized to approve requests to waive laws or regulations governing educator preparation and licensing.

This authorization consolidates the existing procedures of the district applying for individual applicants to an annual blanket declaration for all anticipated emergency permits.  The anticipated numbers and types of credentials are the number of anticipated staff that may be needed during the 2022 – 2023 school year.  Any increase to these anticipated numbers would be subject to the Board’s review and approval.

The District administration recommends that the Board of Education adopt the Declaration of Need for Fully Qualified Educators for the 2022 – 2023 school year.

IX.D.4. San Gabriel Valley Food Services Cooperative Purchasing Group, Annual Membership Agreement (Consent Item)

The Board is requested to approve/ratify the membership agreement between San Gabriel Valley Food Service Cooperative Purchasing Group and West Covina Unified School District.

The West Covina Unified School District, Nutrition Services Department is part of a group of independent school food service directors from Los Angeles County/San Gabriel Valley who have agreed to purchase perishable and staple foods, supplies and USDA commodities in cooperative bidding for mutual benefit via Invitation for Bid (IFB) and/or Request for Proposal (RFP).  The group is referred to as the “San Gabriel Cooperative Purchasing Group”and/or the “San Gabriel Co-op”.

Renewal of membership, with Board Approval, is required annually to remain an active member.


 
Financial Impact:

There are no costs associated with this agreement. The term of the agreement will be effective July 1, 2022 through June 30, 2023.

IX.D.5. Contract Renewal for E-Rate Services (Consent Item)

Rationale:

The District has contracted with CSM Consulting, Inc. since 2005 to prepare documentation, forms and applications regarding the Federal Communications Commission E-Rate Program.

The cost for services rendered regarding the E-Rate application process shall amount to $14,000.00 for the Category 1 services and not to exceed $10,000.00 for additional Category 2 services. Category 1 services include telecommunication and internet access services, while Category 2 services cover internal connections consisting of networking devices and maintenance agreements. The cost will be paid from the District General Fund, however, credits from the E-Rate program will offset the cost of services through the company’s expertise and knowledge of the program. The additional credits are expected to more than cover the cost of the services.

IX.D.6. Authorization to Use National Data Privacy Agreement for the Fiscal Year 2022 - 2023 (Consent Item)

Staff recommends using the National Data Privacy Agreement when entering into contract with software vendors utilizing student data.

The National Data Privacy Agreement is a statewide agreement that districts can use to ensure that the vendor is aware of and complies with California's student data privacy laws.  It will ensure the appropriate use of student data to comply with statewide regulations such as FERPA, COPPA, SOPIPA, PPRA, and AB1584.

Board approval is requested for renewal of the following services:

1. Atkinson, Andelson, Loya, Ruud & Romo, a Professional Law Corporation, will provide legal services for West Covina Unified School District from July 1, 2022 to June 30, 2023.  The firm assists K-12 School Districts with construction law, property equipment leases, asset management, real estate leases, labor and employment, and special education counsel and litigation.

2. 3. Lozano Smith, Attorneys at Law, will provide legal services for West Covina Unified School District from July 1, 2022 to June 30, 2023.  The firm will assist the District with labor and employment, and special education counsel and litigation.

4. Tao Rossini, a Professional Corporation, will provide legal services for West Covina Unified School District from July 1, 2022 to June 30, 2023.  The firm assists the district with construction law, property equipment leases, asset management, real estate leases, labor and employment counsel, and litigation.

 
Financial Impact:
  1. Hourly fees range from $165.00 for paralegal to $345.00 for senior legal counsel. Fees to be paid from the District General Fund.

  1. Massadi Enterprises, Inc. will provide inspection services in accordance with California Division of State Architect (DSA) standards during 2022 – 2023 on an as-needed basis.

  2. Cardinal Environmental Consultants, Inc. will provide air quality and related testing services during 2022 – 2023 on an as-needed basis.  

  3. Paradigm Healthcare Services, LLC will provide Medi-Cal direct and administrative claim services as required by the California Department of Health Care Services (DHCS) and will act as an agent for the District for purposes of submitting reimbursement requests during 2022 – 2023. 

  4. Dixon SmartSchoolHouse, LLC will provide facility planning, including financing and funding options; operational consulting, including LCAP strategies, and other duties as needed to support construction projects for 2022 – 2023.

  5. American Fidelity Administrative Services, LLC will provide Patient Protection and Affordable Care Act (ACA) Compliance which includes Time and Eligibility Tracking and Employer Reporting for the 2022 Tax Year.

  6. Salem Engineering Group, Inc. will provide geotechnical and laboratory testing services for construction jobs during 2022 – 2023 on an as-needed basis.

  7. Piper Sandler & Co. will provide municipal securities disclosure reporting annually to the Securities and Exchange Commission (SEC) as required by SEC Municipal Securities Disclosure Rule 15c2-12 for 2021 – 2022.

  8. Demsey, Filliger & Associates will provide separate footnote disclosure reports as of June 30, 2022 and June 30, 2023, setting for the Statement No. 45 and 75 of the Governmental Accounting Standards Board reporting requirements for the respective fiscal year. The biennial and annual disclosure reports will include updates to the statement of fiduciary net position, statement of changes in fiduciary net position, net OPEB liability and schedule of change in net OPEB liability, and OPEB plan investments.

  9. Blattner & Associates will provide professional services to the West Covina Unified School District to advance district operational and educational outcomes during the 2022 – 2023 school year.

    10. VMA Communications, Inc. will provide communication services during the 2022 – 2023 on an as-needed basis
 
Financial Impact:
  1. Hourly fee of $80.00 per hour based on a 4-hour minimum to be paid from Building Fund, Capital Facilities Fund or Special Reserve Fund – Capital Projects, not to exceed $800,000.00. 

  2. Air quality and related testing services per schedule of fees to be paid from General Fund, not to exceed 30,000.00.

  3. Costs, to be paid (a percentage of Medi-Cal reimbursements not to exceed 10% for first $400,000 reimbursed) from the General Fund.

  4. Hourly fees between $125.00 per hour plus mileage, not to exceed $5,000.00, will be paid from the Capital Facilities Fund or Building Fund.

  5. Costs, not to exceed $28,500.00 to be paid from the General Fund.

  6. Geotechnical Services per schedule of fees to be paid from Building Fund, Capital Facilities Fund or Special Reserve Fund – Capital Projects, not to exceed $600.000.00.

On June 8, 2021, the Board awarded contracts to Durham School Services, L.P., Fairway Charter Service LLC, and Visser Bus Services for transportation services to be used on an “as needed” basis.  A one-year contract for the 2021 – 2022 school year was approved with the right to renew the contract for an additional four (4) one-year successive terms.  It is recommended that the Board renew the contracts for the 2022 – 2023 school years.

It is also recommended that the Board further authorize budget transfers, purchase orders and release of warrants in support of these contracts.

Staff recommends using State, City and other School District Bids to purchase technology supplies, office supplies, classroom supplies, classroom and office furniture, gasoline and diesel fuel, modular lease and purchase, playground equipment, flooring and turf for 2022 – 2023.

In order to take advantage of joint buying power; State, City and School District Bids are made available to state agencies.  These bids allow the school district to purchase school supplies exceeding the bid limit eliminating the need for districts to go out to bid for the same types of purchases individually (Public Contract Code Section 20118).

  • Conduct analyses of the District’s storm water samples.

  • Services to be provided District-wide.

It is also recommended that the Board approve budget transfers, purchase orders and release of warrants in support of this agreement.

IX.D.13. Obsolete Property Blanket Authorization (Consent Item)

Rationale:

BE IT RESOLVED that the Board of Education “blanket” authorize the Director of Purchasing to dispose of old, obsolete property in the manner deemed to be in the best interest of the District throughout the 2022 – 2023 fiscal year.

The Purchasing department accumulates obsolete property on an ongoing basis. Property is deemed obsolete when it is irreparable, beyond economical repair or obsolete for District use. District staff must evaluate obsolete property and sell, recycle, donate or dispose of the property in the best interest of the District, in keeping with guidelines of the California Education Code. The Director of Purchasing is seeking a “blanket” authorization to recycle property on an “as needed” basis without having to have a new board agenda item for each disposal effort. Disposal of obsolete property is an ongoing process throughout the year, waiting for an upcoming Board meeting can delay the process by 2-4 weeks.

Education Code Section(s) 17545 and 17546 allow the Governing Board to sell surplus or obsolete property through public sale, private sale, or to donate such property to a charitable organization, or to dispose of such property at a public dump. Public sale is the District’s preferred method for disposing of obsolete property (excluding e-waste). Where items are of insufficient value to be accepted for sale, the District may sell items by private sale or to a recycler or donate items to a non-profit organization. Should the condition, utility of value of the items preclude these methods, the items may be disposed of at a public dump. The Board has approved this authorization in the past to the benefit of the District.

Bid specifications were developed and a mandatory job walk was completed on April 4, 2022. Bids were received from various contractors with the following result of the lowest qualified bidder: 

  1. CMA Painting Inc. $269,000.00

Exterior Building Paint Various Sites (San Jose Charter School, Merlinda Elementary and Monte Vista Elementary Schools) at the contract price of $269,000.00, plus 10% maximum allowance for change orders.  Total not to exceed $295,900.00.

 

RFP No. 01:2223 – Pizza (Delivered and Ready to Serve)

It is recommended that the Board award Domino’s Pizza (7 participating franchises), American West Restaurant Group (“Pizza Hut”), PJCA-3, LP (dba Papa John’s Pizza), and S.C.A.R., Inc., (dba Hungry Howie’s Pizza), to provide Pizza (Delivered and Ready to Serve for one (1) year.  Only members of the San Gabriel Valley Food Services Cooperative Purchasing Group may contract with any of the four (4) recommended vendors under this RFP as-needed.
