Rationale:

Pursuant to Education Code Sections 52060 and 52064, Local Education Agencies (LEA) must adopt a Local Control Accountability Plan (LCAP) by July 1, 2021, using the State Board of Education adopted template and meeting the eight State Priorities for providing a quality education.

As per the statute, the West Covina Unified School District has participated in the process outlined for all LEAs (Education Code 52062 and 52069):

  1. Met and conferred with members of a Parent Advisory Committee and the District English Learner Advisory Committee.   

  2. Consulted with the special education local plan area administrator.
     
  3. Provided public notification and review of the LCAP draft through posting for comment on the District Website, and notification of the community through public posting of the hearing.  

  4. Hold a public hearing before the Governing Board prior to adopting the LCAP at a separate meeting.

The District administration recommends that the Board declare a public hearing on June 8, 2021, for public input.

Rationale:

Notice is hereby given that the Governing Board of the West Covina Unified School District, at its regularly scheduled meeting to be held on June 8, 2021, will conduct a public hearing regarding the Education Protection Account (EPA) for the 2020 – 2021 fiscal year.

Proposition 30, The Schools and Local Public Safety Protection Act of 2012, approved by voters on November 6, 2012, temporarily increased the state sales tax for all taxpayers and the personal income tax rates for upper-income taxpayers.  The new revenues generated from Proposition 30 are deposited into a state account called the EPA.

Each Local Education Agency (LEA) will receive funds from the EPA based on their proportionate share of the statewide Local Control Funding Formula (LCFF) amount.  A corresponding reduction is made to an LEA’s LCFF entitlement.  Proposition 30 provided that all LEAs have the sole authority to determine how the funds received from the EPA are spent.

All individuals wishing to submit written comments to the District on the EPA may do so on or before June 8, 2021.  All written comments or questions should be addressed to Dr. Drew Passalacqua, Assistant Superintendent, Business Services, West Covina Unified School District 1717 W. Merced Ave, West Covina, CA, 91790.  All individuals wishing to participate in the public hearing are invited to attend the meeting of the Governing Board at the following time and location:

VII.E. Public Hearing on 2021 – 2022 Proposed Budget (Procedural Item)

Rationale:

Per Education Code Sections 42127 and 52062, two separate Governing Board public meetings, held at least one day apart, are now required for the school district budget hearing and budget adoption.  The budget must be available for public inspection for the public hearing.

As advertised in the San Gabriel Valley Daily Tribune, the 2021-2022 proposed budget has been available for public inspection in the Business Services Division of the District until the present date.  Any resident of the district may appear and discuss the proposed 2021-2022 Budget.  The West Covina Unified School District Board of Education will take action to adopt the final 2021-2022 Budget on June 22, 2021.

Bid No. 05:2021 – Transportation Services

On May 19, 2021, bids were received from various transportation providers related to the above referenced bid. It is recommended that the Board award to Durham School Services, L.P., Fairway Charter Service LLC, and Visser Bus Services, Inc., based on the criteria set forth in the bid for transportation services to be used on an “as needed” basis, a one-year contract for the 2021-2022 school year. The District reserves the right to renew the contract for an additional four (4) one year successive terms.

It is also recommended that the Board further authorize budget transfers, purchase orders, and release of warrants in support of these contracts.

The YMCA After School programs (Y-ASES) will be held at nine WCUSD schools.

Rationale:

Education Code Section 42601 authorizes the County Superintendent of Schools to make appropriation transfers, if necessary, at the close of the fiscal year to permit payment of obligations of the district incurred during the 2020 – 2021 school year, if authorized by the District.

It is recommended that the Board of Education approve the County authorization to make appropriation transfers from the specified funds, if necessary.

X.D.9. Resolution for Temporary Inter-Fund Cash Borrowing (Consent Item)

Rationale:

Temporary inter-fund borrowing of cash is permitted by Education Code Section 42603 for K-12 districts. District Governing Board approval is required.  The Governing Board of a school district may direct that moneys held in any fund may be temporarily transferred to another fund of the district for payment of obligation under the following restrictions:

  • No more than 85 percent of the maximum of moneys held in any fund during a current fiscal year may be transferred.

  • The transfer shall not be available for appropriation or be considered income to the borrowing fund.

  • Borrowing shall occur only when the fund receiving the money will earn sufficient income, during the current fiscal year, to repay the amount transferred.

It is recommended that the Board of Education adopt this Resolution to authorize temporary borrowing between funds for fiscal year 2021 – 2022.

Rationale:

Temporary transfer of cash between the District and the Los Angeles County Treasurer is permitted by Article XVI, Section 6, of the California Constitution.  In order to assure sufficient cash to pay obligations in the current fiscal year, should the need arise, the District may temporarily borrow cash from the Los Angeles County Treasurer.

The resolution is effectively an overdraft protection through the Los Angeles County Treasurer.

It is recommended that the Board of Education adopt this Resolution to authorize temporary borrowing of funds from Los Angeles County Treasurer during the fiscal year 2021 – 2022, if the need should arise

X.D.11. Contribution to Self-Insured Schools of California (SISC) to Fund Other Post-Employment Benefits (OPEB) Liability (Consent Item)

Rationale:

The Governmental Accounting Standards Board (GASB) 75 regulation requires governmental employers, including local educational agencies (LEA’s), to account for and report their costs and obligations relating to other post-employment benefits (OPEB).  The estimated OPEB liability as of June 30, 2020 is $3,804,529 based on the study prepared by Demsey Filliger & Associates.

The District will pre-fund the projected OPEB liability over a three year period commencing with year 2020-21.  The funds will be deposited into the SISC approved trust account. 


 
Financial Impact:

$950,000 to be paid from the General Fund
